Tenants, crops, and manufactured homes

Some attachments are meant to leave: trade fixtures and annual crops. A manufactured home follows its own statute.

What you will learn

  1. Not every bolt means the item belongs to the landowner. Ask who installed it, and why.
  2. A tenant's display rack, put in for the business and removable without wrecking the building, is a trade fixture. If the lease is silent, the tenant may take it at the end of the lease.
  3. Tomatoes the grower planted this season are an emblement: personal property. The shrub in the ground is landscaping, and on the resale contract it is an improvement. A manufactured home is its own case — personal property unless the owner elects real property and the statement is filed of record.
